An officer said he smelled a strong odor of alcohol on Fumo and on his breath, and his eyes were bloodshot and glassy. Fumo failed a sobriety test and refused a Breathalyzer test, police said.

He told officers that he had been drinking at work during a whiskey tasting, according to a court document.
