Davis Tool & Die Will Appeal OSHA Claims, Says Electrocution Was Victim's Error

"(This) was apparently the result of human error on the employee's part while servicing a piece of high voltage equipment he was thoroughly familiar with," the compnay said via its attorney.

On Monday, Fenton-High Ridge Patch brought you news that company at which a worker was fatally electrocuted was in trouble with the Feds, specifically the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA)

The company was issued nine serious safety violations related directly to the electrocution. It was fined $77,000 and told it had 15 business days to contest the citations and proposed penalties.

The company has announced through its attorney it plans to do just that, according to a Riverfront Times article.

Attorney Michael Flynn sent RFT this statement on behalf of the company, which basically states although the compnay is upset about the electrocution, it's not their fault but rather the employee's.

"(The business) deeply regrets and is saddened by the loss of the life of one of its valued employees. This employee was well liked and respected by all of his co-workers and was a personal friend of one of the Company's owners.

Based upon the Company's investigation, this unfortunate tragedy was apparently the result of human error on the employee's part while servicing a piece of high voltage equipment he was thoroughly familiar with, and about which he had knowledge of the associated hazards.

This fact was totally ignored by OSHA's investigation. OSHA has chosen instead, to characterize this loss of life as being entirely the result of alleged safety violations by Davis Tool $Die, a Company that has always focused on the well being and safety of its employees."
